Abstract: Die Unterzeichnung eines internationalen Abkommens und die Achtung der darin festgelegten Regeln innerhalb des nationalen Kontexts beziehungsweise die regelgerechte Übertragung der Prinzipien in staatliches Handeln sind nicht die zwei Seiten derselben Medaille. Vielmehr liegt zwischen ihnen eine der existenziellen Fragen des internationalen Rechts: „Does international law matter?“. Mit dem Instrumentarium der Compliance-Analyse wird in dieser Arbeit die Wirkungsmacht der Genfer Flüchtlingskonvention untersucht. Beantwortet werden dabei die Fragen, ob sich die deutsche Rechtsetzung und –sprechung im Zeitraum von 1993 bis 2016 als regelkonform zur Genfer Flüchtlingskonvention darstellt, das heißt ob von einer Compliance Deutschlands mit den internationalen Rechtsregeln gesprochen werden kann (1), wie das asylrelevante Rechtsverhalten Deutschlands, das heißt die Compliance bzw. Non-Compliance mit der Genfer Flüchtlingskonvention, erklärt werden kann (2), und welchen Einfluss auf die bestehende oder nicht bestehende Regelkonformität die Europäische Union hat (3).
The ratification of an international agreement and the compliance with the rules set by the treaty within the national context respectively conform government action are not the two sides of the same coin. In between rather lies one of the most essential questions of international law: Does international law matter? Using the instrument of the compliance-analysis, this paper examines the power of the Convention Relating to the Status of Refugees. Central are the questions if German legislation and jurisprudence comply with the international legal rules (1), how legal state action concerning asylum law can be explained (2), and what influence the European Union has regarding Compliance or Non-Compliance of the Federal Republic of Germany (3).
